1. Agreement to Terms
By downloading, accessing, or using FlySight ("the App"), you agree to be bound by these Terms & Conditions.
If you do not agree to these Terms, do not use the App.
FlySight is a flight performance tracking and analytics tool intended for educational and self-improvement purposes only. It is not a certified aviation instrument.
2. Not for Navigation or Operational Decision-Making
FlySight:
- Is not FAA-certified.
- Is not approved for navigation.
- Does not replace certified avionics.
- Must not be used for real-time operational flight decisions.
All flight decisions must rely on certified instruments, official weather briefings, published procedures, and proper aeronautical judgment.
You assume full responsibility for all flight operations.
3. Eligibility
To use FlySight, you must:
- Be at least 13 years old.
- Comply with all applicable aviation regulations.
- Use the App only for lawful purposes.
If using CFI/student sharing features, you are responsible for obtaining appropriate consent between parties.
4. Account Registration
Certain features require account creation.
You agree to:
- Provide accurate information.
- Maintain the confidentiality of your login credentials.
- Notify us immediately of unauthorized account access.
You are responsible for all activity conducted through your account.
5. Flight Data & Analytics Disclaimer
FlySight provides:
- GPS-based flight tracking
- Trend-based performance analysis
- Consistency metrics
- Historical comparisons
These insights:
- Are estimates based on available device and third-party data
- May contain inaccuracies or data gaps
- Are for informational and educational purposes only
FlySight LLC makes no guarantees regarding accuracy, reliability, or completeness of data.
6. ADS-B & Third-Party Data
FlySight may retrieve publicly available flight data from third-party providers (e.g., ADS-B networks or aviation APIs).
FlySight LLC:
- Does not control third-party data sources
- Is not responsible for inaccuracies in external data feeds
- Does not guarantee availability of ADS-B data
7. Data Sharing (CFI / Student Features)
If you choose to share performance data:
- You explicitly opt in before any sharing occurs.
- You may revoke access at any time.
- Shared reports are informational only.
FlySight LLC is not responsible for how shared information is interpreted or used.
8. Intellectual Property
All software, algorithms, analytics models, branding, content, and design elements of FlySight are the exclusive property of FlySight LLC.
You may not:
- Reverse engineer the App
- Reproduce proprietary analytics
- Redistribute or resell the software
- Use FlySight branding without written consent
9. Subscription & Payments (If Applicable)
If FlySight offers paid features:
- Subscriptions automatically renew unless canceled.
- Payments are processed through Apple's App Store.
- Refunds are governed by Apple's policies.
FlySight LLC does not store payment information.
10. Limitation of Liability
To the maximum extent permitted by law:
FlySight LLC shall not be liable for:
- Flight-related incidents
- Aviation decision errors
- Loss of data
- Indirect, incidental, or consequential damages
- Personal injury or property damage
Use of the App is at your own risk.
11. Indemnification
You agree to indemnify and hold harmless FlySight LLC from any claims, liabilities, damages, or expenses arising from:
- Your flight operations
- Misuse of the App
- Violation of these Terms
12. Termination
FlySight LLC reserves the right to:
- Suspend or terminate accounts
- Restrict access
- Remove content
For violations of these Terms.
13. Changes to Terms
We may update these Terms periodically. Continued use of the App after updates constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the United States.
